Giveaway Official Rules

Eligibility: The giveaway is open to individuals who are at least 18 years old or the age of majority in their jurisdiction of residence, whichever is older, and who are legal residents of USA. Employees of 26 Charms LLC, its affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members and/or those living in the same household of each are not eligible to participate in the giveaway.

Entry Period: The giveaway begins on April 19th, 2024, at 5:00 PM EST and ends on April 24th, 2024, at 11:59 PM EST (“Entry Period”). Entries submitted before or after the Entry Period will not be eligible. 26 Charms LLC reserves the right to extend or shorten the giveaway at their sole discretion.

How to Enter: To enter the giveaway, participants must  Comment on the instagram post with the bundle letter they want. Tag three friends. Follow @26charms on Instagram. Extra entries if you share this post to your stories and tag @26charms. Each participant may submit 10 entries during the Entry Period. Entries that are incomplete, illegible, or fraudulent are void and will be disqualified.

Prize: Winners will win ONE of the 3 charm bundles valued each at $225.00. The prize(s) is/are non-transferable and no cash or other prize substitution is permitted, except at the discretion of 26 Charms LLC. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the winner.

Winner Selection and Notification: Winners of the giveaway will be selected in a random drawing under the supervision of 26 Charms LLC. Winners will be notified via direct message on Instagram from the account the entered from within 5 days following the winner selection. 26 Charms LLC shall have no liability for a winner's failure to receive notices due to spam, junk e-mail, or other security settings or for a winner’s provision of incorrect or otherwise non-functioning contact information.

Rights Granted by Entrant: By entering the giveaway, each participant grants 26 Charms LLC a worldwide, irrevocable, perpetual, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any and all media, whether now known or hereafter devised, for any purpose without further compensation, notification, or permission.

Limitation of Liability: By entering, participants agree to release and hold harmless 26 Charms LLC and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such participant’s participation in the giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the giveaway; (v) electronic or human error in the administration of the giveaway or the processing of entries.

Disputes: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF NY, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this giveaway, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in [insert location] having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this giveaway). Participant further waives all rights to have damages multiplied or increased.
